Mesothelioma Help Center - New York Mesothelioma Lawyer

According to the Environmental Working Group (EWG) more than 10,000 Americans will die each year as a result of asbestos exposure.

New York is a state with a long history of industrial growth. The Empire State is regarded as the birth place of the asbestos manufacturing industry. Asbestos was once widely used throughout the state in many different industries because of its heat and fire resistant properties. More than 116,278 tons of asbestos was shipped into New York throughout the 20th century, much of which came from Libby, Montana over the course of 45 years. To date, New York has had more than 400 sites state wide that have at one point reported asbestos exposure. Many people have spent years working alongside asbestos fibers and asbestos related products, often without their knowledge or any form of protective equipment.

Residents living close to naturally occurring asbestos sites and construction zones have also been unknowingly exposed to asbestos. The highest rates of asbestos exposure in the state of New York occurred between the years 1920-1980, but cases of new exposures are still being reported. The highest amounts of asbestos were found in Queens, Lower Manhattan, Brooklyn, Rochester, Buffalo and Watertown. Asbestos was used extensively in: shipyards, demolition sites, oil refineries, construction sites, aluminum plants, commercial buildings, factories, residential buildings, renovation sites, manufacturing plants, steel mills, power plants, iron mills, chemical plants, auto plants, paper mills, mines, industrial plants, academic buildings, schools, libraries, museums, retirement homes, banks, and in many historic buildings.

New York Workers and Asbestos Exposure

Workers from many professions have been placed at risk of asbestos exposure. Exposure could have taken place at any time, from the initial construction of a building, to any renovation or during a demolition. The most common professions to suffer asbestos exposure include: insulators, plumbers, pipe fitters, shipyard workers, electricians, auto mechanics, oil refinery workers, sheet metal workers, miners, military personnel, veterans, and construction workers.

New York workers even brought home asbestos fibers on their clothes and in their hair, subsequently exposing their friends and family members to dangerous levels of asbestos. Many industries relied on products that contained asbestos. Those employed were exposed to asbestos fibers located in job sites and in equipment. Common pieces of equipment used containing asbestos particles were: ship building equipment, engines, pipe fitting systems, electrical insulation, flooring, ceiling tiles, boilers, pipes, heating systems, furnaces, vents, paints, cement, roofing materials, brakes, drywall and any other heat or fire resistant clothing.

New York is also home to numerous naturally occurring asbestos sites. One site was a mine located in the Staten Island region, another was found on the east state-line near Vermont, and there have been reports of others near job sites where talc mining operations took place. New York also has naturally occurring asbestos deposits in Jefferson County near the area of Gouverneur. Massive amounts of residents and disaster workers were also exposed to asbestos during the tragic events of the World Trade center attack on 9-11, and during World War II, when over 70,000 workers were exposed to asbestos fibers at the Brooklyn Navy Yard. Another concern that residents of New York face, is the crumbling infrastructure of many historic and antique buildings. Many buildings in New York were originally fitted with underground steam pipes that contained asbestos. Many other building materials contained asbestos as well.

Exposure to asbestos has been proven to cause a variety of fatal health conditions including Mesothelioma and Asbestosis. Mesothelioma is a form of cancer that has been linked to asbestos exposure; it is found in the tissues that surround the lungs, heart and abdomen. Symptoms can take upward of 40 years to manifest making a diagnosis difficult. New York currently ranks 3rd in the U.S. for Malignant Mesothelioma Deaths. Because of the delayed onset of symptoms, many New York residents and workers are currently at risk. New York residents exposed to asbestos as far back as the 1940s are still developing asbestos related illnesses today.

New York Asbestos Exposure and Mesothelioma Claims

Over the last 20 years, over 10,000 people in New York have been injured by asbestos. More than 4,088 confirmed New York residents have died from asbestos related diseases, with over half of fatalities were due to Mesothelioma. In Queens alone, there have been over 228 Mesothelioma related deaths and over 62 asbestos related fatalities. It is important to note that the number of Asbestos related deaths has been grossly under estimated due to New York’s massive population and lengthy history of asbestos use. Mesothelioma is an incurable disease with a brief life expectancy following a diagnosis.

Symptoms include: cough, chest pain, shortness of breath, fever, anemia, bowel obstruction, abdominal pain, abdominal swelling, weight loss, finger clubbing and swelling of the face or neck.

Currently there are two types of Mesothelioma Claims:

  • Mesothelioma Personal Injury Claims: where a claim is filed by a person diagnosed with Mesothelioma
  • Mesothelioma Wrongful Death: in which a claim is filed by family members of a person who has passed away from Mesothelioma

Victims of asbestos and those diagnosed with Mesothelioma are entitled to compensation in the form of:

  • Reimbursement for loss of wages
  • Medical expenses
  • Funeral cost
  • Pain and Suffering
  • Physical Impairment
  • Disfigurement
  • Medical Expenses
  • Economic Damages
  • Emotional Distress
  • End-of-Life Expenses
  • Future Medical Bills
  • Loss of Income
  • Loss of Parental Care
  • Loss of Spouse
  • Product Liability
  • Punitive Damages
  • Monetary Compensation
  • Any other expenses not covered by a patient’s insurance coverage.

While no amount of compensation can be made for damages caused by asbestos and related diseases, monetary compensation can help with any economic hardship brought on by this terrible ordeal. Monetary compensation can also assist with end of life expenses and make a difference in the lives of family members who are left behind by victims of an irresponsible industry. Asbestos Manufacturers have placed the lives of millions of Americans at risk for the sake of profits. The dangers of asbestos were even withheld from workers despite numerous medical journals at the time placing asbestos at the epicenter of many health risks.

As the number of diagnosed cases of Mesothelioma increased, so did the number of lawsuits in the state of New York. The statute of limitations is 3 years from the diagnosis of Mesothelioma and 2 years from the occurrence of a wrongful death. New York law entitles victims of asbestos exposure to receive compensation for damages related to any asbestos related injury. In order to receive the appropriate compensation, a law firm will need to know: what type of mesothelioma one has been diagnosed with, if the disease can be treated, the dates of exposure, and where the exposure took place. Also any information regarding the types of products used that led to exposure and which companies could be held liable. This information can be attained through the combined efforts of a victim in need of compensation and the law firm that will represent them.

Those responsible for damages are: asbestos manufacturers, landlords and any companies that were involved in the shipment of asbestos. There is also a greater liability for companies that willfully employed personnel at worksites that were known to have high levels of asbestos, but failed to warn their employees or take appropriate action to minimize health risks.

New York has accelerated legal cases involving diagnosed Mesothelioma cases, and cases involving terminal asbestos related injuries. Every May and December, the New York court system chooses cases involving terminally ill patients that will go to trial within 6 months. These trials are generally resolved quickly.

New York has determined that asbestos manufacturers, distributors and employers are to be held liable for asbestos related personal injuries and wrongful deaths. Throughout the state, there have been multi-million dollar settlements and verdicts that were either ruled on behalf of the plaintiff or settled out of court.

Here is a list of successful cases that ruled in favor of those injured in the state of New York:

$2.25 Million dollars was awarded to a former New York electrician who had worked at the Brooklyn Navy Yard and developed Mesothelioma as a result of asbestos exposure.

$2.5 Million dollars was awarded to the family of a New York pipe fitter who died from Mesothelioma after years of asbestos exposure during his employment.

A New York jury ruled in the favor of the estates of a former electrician and a former seaman, both of whom worked at the Brooklyn Navy Yard. The two men died as a result of their exposure to asbestos. A settlement of $22 Million dollars was awarded to both of their estates.

$19.5 Million dollars was awarded to a New York resident that died of Mesothelioma after being exposed to asbestos near his home.

$5 million dollars was awarded to a Navy Veteran who served as a Boilerman. He developed Mesothelioma after being exposed to asbestos during his service to our country.
